Terms and Conditions

1. Definitions

• HuurScanner / we / us: the provider of the Platform, with the corporate identity as set out under article 13.
• Platform: the website, services and functionalities of HuurScanner, accessible via huurscanner.nl.
• User / you: any natural person who creates an account or uses the Platform.
• Account: the personal registration through which you gain access to the Platform.
• Premium: the paid monthly subscription of €14.99 per month that gives access to additional functionalities and is cancellable monthly.
• Stripe: Stripe Payments Europe Ltd, which processes the payments and the recurring monthly collection.
• Property data: information about rental homes that can be found via the Platform.

2. Description of the service

HuurScanner is a search platform for rental homes that helps tenants find a suitable home more quickly. The Platform offers, among other things, a searchable overview of rental homes, real-time availability and e-mail alerts.

HuurScanner is explicitly not a landlord, estate agent or intermediary and is not a party to any rental agreement concluded between you and a landlord or other third party. The Platform solely facilitates the search for homes.

HuurScanner endeavours to present the Property data as up to date and accurate as possible, but gives no guarantee as to the accuracy, completeness or availability of the displayed Property data. Homes may already be rented out or may change in price or conditions without this being immediately reflected in the Platform.

3. Account and obligations of the user

To use certain functionalities you must create an account. You are yourself responsible for providing correct and complete information and for keeping your login details confidential.

You undertake to:

• use the Platform exclusively for personal, non-commercial purposes;
• not misuse the Platform, including the automated extraction, copying or resale of data;
• not disrupt the security or operation of the Platform;
• not perform any acts that are contrary to the law or to the rights of third parties.

In the event of (suspected) misuse or breach of these terms, we are entitled to suspend or terminate your access to the Platform.

4. Free use and Premium

The Platform is free to use in its basic form. In addition, we offer Premium with additional functionalities.

Premium is a monthly subscription of €14.99 per month. It renews automatically every monthand the amount is collected automatically each month , until you cancel. You can cancel monthly via your dashboard , with no notice period. After cancellation your access continues until the end of the month you have already paid for and is not renewed thereafter.

5. Term and cancellation

Because Premium is a monthly subscription , it renews automatically every month. You can cancel monthly via your dashboard. After cancellation your access to the Premium functionalities continues until the end of the current paid monthand is not renewed thereafter. There is no notice period and no further amounts are charged after the end of the cancelled month.

6. No right of withdrawal (digital service starting immediately)

Premium is a digital service that starts immediately after purchase . At checkout you expressly consent to immediate delivery and acknowledge that you thereby waive your statutory right of withdrawal once delivery has started. There is therefore no cooling-off period and no money-back guarantee after purchase. Do you have a question about your purchase? Then contact us at support@huurscanner.nl.

7. Prices and payment

All prices are stated in euros and include any taxes due, unless stated otherwise. Premium costs €14.99 per month and is a monthly subscription that is collected automatically each month. Payments are processed by Stripe (Stripe Payments Europe Ltd). When you pay your first instalment via iDEAL, a SEPA Direct Debit mandateis set up automatically, so that subsequent months are collected automatically.

The subscription renews every month until you cancel it. You can cancel monthly via your dashboard, with no notice period. In addition to these terms, Stripe's terms also apply to the payment processing.

8. Intellectual property

All intellectual property rights relating to the Platform, including the software, design, texts, logos and the name HuurScanner, belong to HuurScanner or its licensors. It is not permitted to copy, reproduce, distribute or make public (parts of) the Platform without our prior written consent.

9. Limitation of liability

The Platform is provided “as is”. To the extent permitted by law, we exclude all liability for damage arising from the use of, or the inability to use, the Platform, including damage resulting from incorrect or incomplete Property data, missing out on a home, or the actions of third parties.

Insofar as we would nevertheless be liable, our liability is limited to the amount you paid to HuurScanner in the twelve months preceding the event causing the damage. This limitation does not apply in the case of intent or wilful recklessness on the part of HuurScanner.

10. Changes to the terms

We may amend these Terms and Conditions from time to time. The most current version is always available via the Platform. In the event of material changes, we will inform you in good time, for example by e-mail. If you continue to use the Platform after a change takes effect, this constitutes acceptance of the amended terms.

11. Applicable law and disputes

These Terms and Conditions and the use of the Platform are governed exclusively by Dutch law . We will first attempt to resolve disputes arising from or relating to these terms through mutual consultation. If we cannot resolve them, disputes will be submitted to the competent Dutch court, unless mandatory law designates another competent court.
